VCN REFUND, RETURN & CANCELLATION POLICY
(For Customers and Direct Sellers)
This Refund, Return and Cancellation Policy (“Policy”) governs the terms and conditions under which products sold by Falcon Marketing Pvt. Ltd., operating under the brand name VCN (Vcare Network) (“Company”), may be cancelled, returned, or refunded. This Policy is applicable to all purchases made through the Company’s authorised website, digital platforms, or approved sales channels and shall be read in conjunction with the Customer Agreement, Direct Seller Agreement, and other policies published by the Company from time to time.
1. Product-Centric Nature of Business
The Company operates on a product-centric direct selling model, wherein products are sold to end consumers for personal consumption. The Company does not charge any joining fees, does not mandate compulsory purchases, and does not guarantee income or assured returns. All refunds, returns, and cancellations are governed strictly by this Policy and applicable consumer protection laws, and not by any oral assurances, representations, or promises made by any individual.
2. No Guaranteed Satisfaction or Result-Based Refunds
The Company does not offer refunds based on dissatisfaction with results, expectations, or perceived benefits. Individual outcomes may vary depending on usage, lifestyle, dietary habits, and personal health conditions. Refunds shall not be granted solely on the basis that a product did not deliver a particular health, wellness, or lifestyle outcome.
3. Misrepresentation by Individuals
The Company shall not be bound by any oral promises, assurances, representations, or commitments made by any Direct Seller or any third party concerning refunds, guaranteed results, return eligibility, or any matter that is inconsistent with or beyond the Company’s published terms, policies, or agreements. All refund, return, and cancellation decisions shall be governed exclusively by this Policy and applicable law.
4. Eligibility for Returns and Refunds
- The Customer acknowledges that the products sold by the Company include health supplements, nutraceuticals, wellness and personal care products, which are sensitive in nature and governed by strict regulatory and hygiene standards. Accordingly, returns and refunds are permitted only under limited and lawful circumstances
- Requests for return or refund must be raised within [__] days from the date of delivery, subject to verification and eligibility under this Policy and applicable consumer protection laws.
- A product shall be eligible for return or refund only where the product delivered is defective, damaged, expired, or materially different from what was ordered, or where the product is delivered in a condition rendering it unfit for use due to reasons attributable to the Company or its authorised logistics partners.
- All other return or refund requests shall be examined strictly in accordance with this Policy and applicable law.
- Returns shall be accepted only if the product is unopened, unused, untampered, in its original packaging with labels and seals intact, and accompanied by the original invoice.
- For the purpose of initiating a return or refund request, the Customer shall be required to provide reasonable information and evidence, including proof of purchase (invoice), details of the product, and photographs or other evidence demonstrating the defect or issue, where applicable. The Company reserves the right to inspect or verify the returned product before approving any refund or replacement.
5. Non-Returnable and Non-Refundable Products
- In view of regulatory compliance, consumer safety, and hygiene considerations, the following categories of products shall not be eligible for return or refund, except where mandated by law:
Products that have been opened, partially used, consumed, tampered with, or damaged after delivery; Products damaged due to improper storage, misuse, overconsumption, or failure to follow usage instructions; Products returned without original packaging, labels, seals, or invoices; Products returned beyond the prescribed return window.
- The Customer expressly understands that nutraceutical and wellness products, once opened, cannot be resold and therefore cannot ordinarily be accepted for return.
6. Refund Processing
- Where a return or refund is approved in accordance with this Policy, the Company shall process the refund through the original mode of payment or such other lawful mode as deemed appropriate, within a reasonable timeframe and in compliance with applicable consumer protection laws.
- The Company shall not be liable for delays caused by banks, payment gateways, or third-party service providers beyond its reasonable control.
7. Cancellation of Orders
- Orders may be cancelled within [__] hours of placement or prior to dispatch, whichever is earlier. Once a product has been dispatched, cancellation shall not be permitted, and the Customer may only seek return or refund strictly in accordance with this Policy.
- The Company reserves the right to cancel an order in circumstances including but not limited to unavailability of stock, pricing or listing errors, regulatory restrictions, or suspected fraudulent or abusive activity.
8. Buy-Back / Repurchase (Direct Sellers)
- Where applicable and in compliance with the Consumer Protection (Direct Selling) Rules, 2021, the Company may provide a buy-back or repurchase facility to Direct Sellers for unopened, unused, and resalable products, subject to submission within the prescribed period, products being in original saleable condition, and deductions as permitted under applicable law for handling, logistics, or administrative costs.
- No buy-back shall be permitted for products that are expired, damaged, opened, or otherwise unsaleable.
9. Termination or Suspension and Refund Rights
Termination or suspension of a Customer or Direct Seller account for violation of policies, misconduct, fraud, or inactivity shall not automatically entitle such person to a refund. Refunds, if any, shall be processed only for eligible transactions in accordance with this Policy and applicable law.
10. Force Majeure and Regulatory Restrictions
The Company shall not be liable for any inability to accept returns or process refunds due to events beyond its reasonable control, including but not limited to government orders, pandemics, regulatory bans, product recalls mandated by authorities, supply chain disruptions, or other force majeure events. In such cases, the Company shall act strictly in accordance with statutory directions and consumer protection laws.
11. Grievance Redressal
Any grievance relating to refunds, returns, or cancellations may be raised through the Company’s designated customer support channels as notified on its website. The Company shall endeavour to resolve such grievances within the timelines prescribed under applicable law.
12. Policy Updates
The Company reserves the right to amend or update this Policy to comply with changes in law, regulatory requirements, or business operations. The latest version published on the Company’s website shall be binding.
13. Governing Law
This Policy shall be governed by and construed in accordance with the laws of India. Subject to statutory remedies available under the Consumer Protection Act, 2019, courts at Delhi shall have jurisdiction.
